Today’s Legal Enlightenment (Saturday, December 18, 2021)-ELIMINATION OF CRIMINAL CONSPIRACY IN CORRUPTION CASES

Setya Novanto (the Applicant) submitted a judicial review related to Article 15 of the Corruption Law which states that anyone who conducts experiments, assists or conspires to commit a criminal act of corruption, shall be punished with the same punishment as referred to in Articles 2, 3, 5 to Article 14. The word “criminal conspiracy” in this article refers to Article 88 of the Criminal Code. The Constitutional Court granted the request and specifically stated that the term “criminal conspiracy” in Article 88 of the Criminal Code cannot be used in other legislation.
