Today’s Legal Enlightenment (Wednesday, 2 March 2022)-“CUSTOMARY DECISIONS ON VILLAGE SETTLEMENT  DO NOT BIND THE JUDGE”

Customary Decision on Village Settlement  is not binding to the District Court Judge and is only considered as a guideline, so that if there is a strong legal reason, the District Court Judge can deviate from the customary decision. In this case, the strong legal reason is the fact that later it turned out that the Plaintiff was not the legal heir of Lai Buatua.

Supreme Court Decision No. 436 K/SIP/1970 dated 30 June 1971
