The act which is an element of Article 378 of the Criminal Code concerning fraud is to persuade people to make debts or write off receivables, instead of persuading people to give loans. So the act that is alleged to the applicant of the appeal to the supreme court that he has persuaded the witness to give him a loan is not a fraud.
