CORRUPTION OF A PROJECT BASED ON THE SUPERIOR’S ORDER

A state civil apparatus (ASN) at the Forestry Service, on orders from superiors, was proven to have deviated from the execution of the reforestation project. Their action has harmed the country’s finances, but they did not do it of their own volition. Therefore, the juridical responsibility for the corruption crime must be borne by the superior who gave the order, not the ASN who carried out the order of their superior.
