Today’s Legal Enlightenment (Monday, November 21, 2021)-EVALUATION OF WHETHER OR NOT A JUDGE’S DECISION IS FLAWED

Whether or not a judge’s decision is flawed must be reviewed from the decision principles that must be applied in the decision. These principles are regulated in Article 178 HIR/189 RBG and Article 50 of Law No. 48 Year 2009 concerning Judicial Authority, namely:

  1. Contains a clear and detailed consideration
  2. Mandatory to adjudicate all parts of the lawsuit
  3. Cannot grant more than the demands
  4. Spoken in public

Hasanudin S.H., M.H., Tilamuta District Court

Supreme Court Decision No. 641 K/Pdt/1993 dated June 27, 1996 has also made Article 178 HIR the basis for its decision.
