To define a law as lex specialis or lex generalis, it is determined by the following principles:

  1. The laws must be in the same legal regime (as if the laws are in the civil law regimes, for example between general civil law and commercial law, between general criminal law and certain military criminal laws).
  2. The laws are in the same level (such as between law and law, or between government regulation and government regulation).
  3. The laws govern the same matter (such as between contract law and contract law).
