ELEMENTS OF ARTICLE 480 OF THE CRIMINAL CODE (KUHP) CAN NOT BE PROVEN IF THE DEFENDANT DOES NOT KNOW OR SUSPECT THE GOODS ARE FROM A CRIME
 
If the defendant does not know or suspect that the goods originate from a crime, then one of the elements of Article 480 of the Criminal Code cannot
be proven. Therefore, the defendant must be acquitted of charges and not released from prosecution.
 

Supreme Court Decision No. 1130K/Pid/1985
 
Article 480-1 of the Criminal Code states that committing certain acts, which include selling and buying goods that are known or reasonably suspected
to originate from criminal acts, are categorized as crimes of collection.
