PLAINTIFF/EMPLOYEE SHOULD SUE THE LIMITED COMPANY AS A LEGAL ENTITY REPRESENTED BY THE BOARD OF DIRECTORS
 
The plaintiff (Cassation Petitioner) only sued the Head of the Genteng Branch of PT WOM Finance and did not sue PT WOM Finance as a legal entity
which is represented by the directors following the provisions of Article 94 of Law Number 40 of 2007 concerning Limited Liability Companies, not Branch Managers;
 
The management of the Genteng Branch cannot act on behalf of the Limited Liability Company without power of attorney from the Directors of the Limited
Liability Company, so Plaintiff must sue the Limited Liability Company/Defendant as a legal entity. Therefore, the lawsuit was rejected.
