Today’s Legal Enlightenment (Wednesday, 10 August 2022) – THE GRACE PERIOD TO FILE A CLAIM FOR THIRD PARTIES NOT DIRECTLY ADDRESSED BY A STATE ADMINISTRATION DECREE IS COUNTED ON A CASE-BY-CASE BASIS
The grace period for a third party not directly addressed by a State Administration Decree to file a claim, as referred to in Article 55 of Law No. 5 of 1986, is counted on a case-by-case basis starting from when the third party regards that its interests have been harmed by the State Administration Decree and already aware of the existence of the decree.
