THE SETTLEMENT DEED IS INVALID BECAUSE THERE IS AN ERROR IN PERSONA

A “Settlement Deed” agreed upon by the plaintiff and the defendant in a civil lawsuit at the District Court, which was then ratified by the Judge and outlined in a court decision. If in the future, it turns out that there is an error in persona in the Settlement Deed, then the “settlement agreement,” following the provisions of Article 1959 of the Civil Code, is invalid. As a result of the law, it cannot be used as a basis for executing the deed.

– Supreme Court Decision No. 1944 K/1991, dated 15 February 1992.
