Today’s Legal Enlightenment (Sunday, June 5, 2022) – “A LAWSUIT TO CLAIM BACK THE PROPERTY OF DIVORCE SETTLEMENT”

A lawsuit to claim back the property of divorce settlement from a third party who illegally controls it, does not have to be filed by husband and wife together, but can be filed by the husband or wife themselves (i.e. the lawsuit is filed by the wife herself), because in this case there is no interest for the opposing party which requires the participation of both husband and wife.

Supreme Court Decision No. 231 K/Sip/1956 dated December 16, 1957
