INTENTIONAL WITH CONFIDENCE OF POSSIBILITY (DOLUS EVENTUALIS)

Still remember the deadly Metromini bus case that killed 33 passengers on March 6, 1994 at Jakarta?
Such a driver’s actions are categorized as “INTENTIONALLY WITH CONSCIOUSNESS POSSIBILITY or DOLUS EVENTUALIS”, meaning that the perpetrator (the driver) can estimate the possibility a result will occur, even so he does not hold back his lust not to do the deed. The driver was found guilty of murder (Article 338 Criminal Code) and persecution (Article 351 paragraph 1 of the Criminal Code).
