Today’s Legal Enlightenment  (Friday, 29 July 2022 ) –

“A LEGAL RELATIONSHIP BASED ON A FINANCING AGREEMENT DOES NOT INCLUDE CONSUMER DISPUTES IF THE PARTIES TO THE AGREEMENT ARE IN DISPUTE”

The legal relationship between the Plaintiff and the Defendant was based on a joint financing agreement with a fiduciary transfer of property, which implements a civil law relationship and is not regarded as a consumer dispute, as referred to in Law No. 8 of 1999. Therefore, the Consumer Dispute Settlement Agency is not authorized to adjudicate the case.
