Today’s Legal Enlightenment (Friday, 19 August 2022) – THE LIMITATION ON ADVOCATES’ IMMUNITY RIGHT

The Constitutional Court decision states that Article 16 of the Advocates Law has no binding legal force as long as it is not interpreted as “Advocates cannot be prosecuted both civilly and criminally in carrying out their profession IN GOOD FAITH for the benefit of the client’s defense inside and outside the court hearing.”

→ Constitutional Court Decision No. 26/PUU-XI/2013

Thus, if there is bad faith when an Advocate is working, the right of immunity or legal immunity for the Advocate becomes invalid.

Kind Regards,
