DEMURRER OF COURT COMPETENCY AS A REASON FOR CASSATION
 
The Applicant for Appeal to the Supreme Court (cassation) submitted the Relative Competency Demurrer of the District Court as a “Cassation Objection”
because it had been violated by Judex facti. This objection cannot be accepted by the Supreme Court on the grounds that: according to Article 133 HIR, the demurrer must be filed in the Defendant’s answer in a hearing at the District Court.
