TODAY’S LEGAL ENLIGHTENMENT (Monday, 17 October 2022) – The unfulfillment of obligations in a legally made agreement by the parties is not fraud, but default, which is a civil law matter, unless the agreement is based on bad faith

Whereas based on these facts, the Supreme Court believes that the legal relationship that exists between the Defendants and the victim witnesses is civil-law-based in the form of a debt and credit relationship with collateral for a plot of garden land and land or house belonging to the Defendants, and it turns out that in this legal relationship, the Defendants broke their promise or default by not surrendering their garden land and land or house to the victim’s witness. The defendants’ actions are not criminal acts but civil law, which can be settled through civil law.
