Today’s Legal Enlightenment (Monday, November 22, 2021)-IMPRISONMENT FOR A CIVIL SERVANT WHO REMARRIES EVEN THOUGH HE/SHE IS STILL IN A MARRIAGE
The decision of the Religious Court and the High Religious Court has granted the husband’s (Plaintiff) claim to divorce his wife (Defendant). The wife then filed an appeal to the Supreme Court, but the husband remarried before the Appeal to the Supreme Court Decision was issued. Legally, the husband’s actions have fulfilled the elements of a criminal offense in Article 279 (1) 1 of the Criminal Code because he is still legally bound in marriage with his wife (the Defendant). The husband was sentenced to 4 months in prison and detained.
