Public Information Disclosure Dispute

With the issuance of Law Number 14 of 2008 concerning Public Information Disclosure, which aims for transparency and the implementation of good governance, anyone can submit a request for public information (actio popularis). However, in examining the dispute over the disclosure of public information, consideration must be given to whether there is an interest with implications for the Plaintiff’s legal standing. This is in line with the point d’interest point d’action principle in the Procedural Law of the State Administrative Court as referred to in Article 53 paragraph (1) of Law Number 5 of 1986 concerning the State Administrative Court, and Article 36 paragraph (1) letter b Information Commission Regulation Number 1 of 2013 concerning Procedures for Settlement of Public Information Disputes.
