Today’s Legal Enlightenment (Monday, December 6, 2021)-REGARDING THE COURT COMPETENT TO ADJUDICATE THE DERDEN VERZET FILED AGAINST EXECUTION

Facing a third-party rebuttal lawsuit (Derden Verzet) against execution, the one authorized to adjudicate the Derden Verzet is the District Court which issues the “Determination of Execution Order” and not the District Court which receives the delegation of execution.

Supreme Court Decision No. 1982/Pdt/1994 dated April 29, 1998
