NOT FULFILLING YOUR PROMISE TO GET MARRIED IS AN AGAINST THE LAW BECAUSE IT VIOLATES THE NORMS OF DECENCY AND PROPRIETY IN SOCIETY
The Supreme Court of Justice granted the appeal of the Cassation Petitioner/Plaintiff. In Supreme Court Decision No. 3277 K/Pdt/2000, judex factie is considered to have misapplied the law. The Panel considers that failure to fulfill the promise to marry means that the Defendant has violated the norms of decency and appropriateness of society, and that the Defendant’s actions are unlawful.
Because the act of not fulfilling the promise to marry caused losses to the Plaintiff, the original Defendant was obliged to pay compensation in the amount specified in the decision. The compensation amounted to IDR 7.5 million as compensation for the costs that the Plaintiff had incurred to support the Defendant’s living expenses while the two of them were having an affair.
