Today’s Legal Enlightenment (Wednesday, 17 August 2022) – DEFENDANT IS DISMISSED FROM ALL CHARGES BECAUSE HE WAS CONDUCTING AN OFFICE ORDER
According to the Supreme Court, Frederick ST Siahaan, the former Director of Finance of PT Pertamina, signed a Sale & Purchase Agreement as guarantor based on Karen Agustiawan’s mandate as President Director. Frederick’s action was an office order in accordance with Article 51 paragraph (1) of the Criminal Code. Therefore, Frederick as a defendant could not be blamed and was dismissed from all charges. (ontslag van alle rechtsvervolging).
