Today’s Legal Enlightenment (Tuesday, April 19, 2022)-
“DISTRICT COURT SELECTED IN THE GROSSE DEED OF MORTGAGE”
The District Court which is chosen as the domicile by the parties in the Grosse Deed of Mortgage, whose jurisdiction is located on the land which is the collateral, then this District Court has the authority to conduct the execution if the Debtor is in default, even though the Debt and Receivable Principal Agreement have chosen another domicile, namely the Central Jakarta District Court. The selection of a specific domicile in the Grosse Deed of Mortgage, namely the Tangerang District Court, should be followed.
