The receipt of money from a citizen of a state to employ a state citizen cannot be regarded as an act of corruption, but rather as a act of fraud in order to enable someone to become a taxpayer.

The accused was named Herman bin H. Ilyas who works and has the status of Civil State Officer (PNS) offers someone named Siti Mainar to be accepted as CPNS in Sarolangun in exchange for Rp50,000,000,00. However, City Mainar is not accepted as CPNS Sarolangun. For his actions, the accused was charged with fraud and sentenced to one year in prison. The Sarolangun State Court issued a six-month sentence, which was confirmed by the Jambi State Court and the Supreme Court.
