Remember the deadly Metromini bus case that killed 33 passengers on March 6, 1994 in Jakarta? The driver’s actions are categorized as “DELIBERATELY WITH THE REALIZATION OF POSSIBILITY OR DOLUS EVENTUALIS“, meaning that the perpetrator (driver) can predict the possibility of the outcome, even so he did not restrain his desire not to do the act. The driver was found guilty of murder (Article 338 Criminal Code) and maltreatment (Article 351 paragraph 1 Criminal Code).
