Today’s Legal Enlightenment (Sunday, December 5, 2021)-INDONESIAN CITIZENS WHO BECOME FOREIGNERS LOSE OWNERSHIP OF THE LAND

An Indonesian citizen owns a piece of land based on the “Certificate of Land Ownership”, then his Indonesian citizenship is revoked based on the Decree of the Minister of Law and Human Rights and the determination of the District Court so that he is a foreigner. Based on Article 21 in conjunction with Article 26 (2) Agrarian Law No. 5/1960, the land became “State Land” and National Land Agency revoked the holding Certificate of Land Ownership No. 89 from the old owner and gave it to the new applicant – an Indonesian citizen by issuing a new Certificate of Land Ownership in the form of Building Rights. The old owner’s lawsuit against National Land Agency and others was rejected because he had no legal interest in suing the issuance of the “New Certificate” of Building Rights.
