Today’s Legal Enlightenment (Saturday, November 27, 2021)-EXPLORING THE SUBSTANSIAL JUSTICE ON THE BASIS OF THE ULTIMATE JUSTICE IN THE PROCESS OF REVIEW TO THE SUPREME COURT IN CIVIL CASES
The Panel of Judges is of the opinion that the sense of justice is not only viewed from a formal legalistic perspective that can be made possible through fabrication, but must also be viewed from a substantive justice perspective by considering the conditional aspects that influence it. If there seems to be any indication of a perversion of the law behind the fabrication, then the Judge must explore the true truth on the basis of the essential truth. The Panel of Judges at the Review level does not limit it to mere formal issues (legal justice) but tries to seek and find the truth and true justice (substantial justice).
