A punishment that is born of dishonesty or fraud or not based on law and justice is corrosive to claims of state legitimacy based on the values of the Criminal Justice System that respects individual rights. In this context, failure to enforce justice (miscarriage of justice) will pose a danger to the “moral integrity of the criminal process.” Furthermore, this can undermine public confidence in law enforcement.
