“CIVIL EXECUTION WITH CRIMINAL SEIZURE”
A plot of disputed land which is controlled by the Defendant has been placed for security seizure (CB) by the State Court in a civil case. A year later the land was confiscated again by the Prosecutor’s Office as evidence of the criminal act of corruption that was indicted against the Defendant mentioned above. Although the land has been placed by CB in a civil case much earlier than the prosecutor’s confiscation, based on Article 39 paragraph (2) of the Criminal Procedure Code, the confiscation in a criminal case is legal according to law.
