Today’s Legal Enlightenment (Friday, February 4, 2022)-“VICARIOUS LIABILITY”
Even though individually the accused’s actions occurred because of the “mens rea” of the accused, but because the act was solely for the benefit of the com, the Supreme Court was of the opinion that what the accused did was desired or “mens rea” from the 14 corporations, thus imposing criminal responsibility “individual liability” with “corporate liability” must be applied simultaneously as a reflection of the doctrine of respondeat superior or vicarious liability applied to criminal liability as the personification of the corporation it represents as duties and responsibilities, after all, what the accused did has been decided collectively.
